SCOPE OF SERVICES PROVIDED BY SAGKEENG HEALTH CENTRE FOR FIRST NATIONS DRINKING WATER CLASS ACTION

The purpose of this notice is to notify you that Fort Alexander Health Centre Inc. and Sagkeeng First Nation are not providing support, assistance or advice, legal or otherwise, regarding the First Nations Drinking Water Class Action Claims Process (“Claims Process”) and are not, and have not, held themselves out to be qualified to provide services in relation to the Claims Process.

Any requests for assistance pertaining to the Claims Process and/or Claims Forms must be made to the Claims Administrator, Deloitte, or Class Counsel McCarthy Tetrault LLP and Olthuis Kleer Townshend LLP. However, in acknowledgment of the difficulty experienced by Sagkeeng First Nation band members in accessing copies of the Claims Forms and transmitting the Claims Forms to the Claims Administrator as part of the Claims Process, the Fort Alexander Health Centre Inc. is providing limited support for the purposes of assisting band members in accessing the Claims Process. For greater clarity, Fort Alexander Health Centre Inc. and Sagkeeng First Nation is not, and will not perform any substantive work, or provide any substantive support, assistance or advice, legal or otherwise, with respect to the Claims Process and/or the Claim Form(s).

Claimants are solely responsible for ensuring they comply with all aspects of the Claims Process including all aspects of the preparation, completion and delivery of the Claim Form and any other form, document or information that may be required, to the Claim’s administrator, including being solely responsible for ensuring that the Claims Form(s) are transmitted to the Claims Administrator by such methods as facsimile, by obtaining and retaining a copy of the facsimile confirmation sheet.

Fort Alexander Health Centre Inc. and Sagkeeng First Nation, including but not limited to their employees, agents, Chief and Band Councillors, are NOT responsible for any errors and/or omissions that may exist in relation to a Claimant’s submission or their compliance with the Claims Process generally, and/or delivery of any documentation to the Claims Administrator.
